This is nothing new. I actually wrote a post about a woman who got out of a DUI by making the same claim. You can find that story here.

This story has a bit more to it though. Ray Lewis (not that Ray Lewis) who works for the Oregon Department of Fish and Wildlife, was transporting salmon. He was involved in an accident, and one witness claimed after the crash there were fish "just floppin' around everywhere."

At the time of the crash, Lewis' blood alcohol content was a whopping .29. That is well over the legal limit of .08. However, Lewis claims his BAC was so high because he suffers from "auto-brewery syndrome." This is an actual thing where someone's body can produce alcohol in the stomach. Certain factors lead to this, such as a diet high in yeast.

According to a blog post by lawyer and legal scholar Jonathan Turley, Lewis has a meeting with his employer later this month, and he expects to be fired.

I'm going to bring up the same point that I did in the last post because I haven't been able to find any more info on it. But if you have auto-brewery syndrome, wouldn't you feel drunk? I mean, I'm pretty sure there have been a few nights, possibly more, where my BAC is over .20, and I could barely walk. So as it brews your stomach you don't feel yourself getting drunk? If anyone out there knows, please let me know. I've now become fascinated with auto-brewery syndrome.
